A Utah judge ruled Tuesday that Tyler James Robinson, 23, will stand trial for the murder of far-right activist and political commentator Charlie Kirk. Judge Tony Graf determined that prosecutors have provided sufficient evidence to proceed with aggravated murder charges.
The shooting took place in September 2025 during a rally at a Utah college campus. Prosecutors allege that Robinson shot Kirk in the neck from a rooftop more than 400 feet away at the open-air event. Robinson allegedly committed the act because he was fed up with the hate Kirk spread.
Because of the aggravated murder charges, Robinson is now eligible for the death penalty. The judge confirmed that there is enough evidence to support this charge as the case moves toward trial.
Erika Kirk, the widow of the activist, called the ruling an important step in her family's pursuit of justice.
