The US Supreme Court ruled unanimously on Thursday that the government cannot categorically bar marijuana users from possessing firearms, a decision that strengthens the Constitution's Second Amendment.
The justices sided with Ali Danial Hemani, a Texas man who challenged a federal law prohibiting habitual users of controlled substances from owning guns. Hemani argued that the law violated the Second Amendment, noting that he had not been charged with other crimes or accused of using a weapon while under the influence.
The decision is a loss for President Donald Trump's Republican administration, which had defended the 1968 law. However, the ruling stopped short of precisely defining which types of drugs, if any, pose a special risk of misuse of firearms.
