Federal prosecutors in Texas have charged Wilber Rafael Garcés Pérez, a 28-year-old Venezuelan delivery driver, with assaulting, resisting, interfering, and impeding a federal officer. The charges stem from a September 20 incident in Austin, where Garcés Pérez was shot by a federal immigration agent while making DoorDash deliveries.
According to a criminal complaint, Garcés Pérez is accused of striking an officer with his car's side mirror while attempting to drive away. He made an initial court appearance in an Austin federal court on Tuesday.
Attorneys for Garcés Pérez state that a bullet remains lodged in his spine, which they say is causing grave danger. Garcés Pérez has disputed the government's account of the events that led to the shooting.
