Former FBI Director James Comey has formally asked a federal judge to dismiss charges accusing him of threatening to kill President Donald Trump. On Monday, Comey and his attorneys urged the court to throw out the federal prosecution.
The charges stem from an Instagram post in which Comey shared a photo of seashells. The prosecution alleges that the shells formed the message "86 47," which is interpreted as a threat against the president.
Comey argues that the criminal charges should be dropped because his speech is protected by the First Amendment.
